Sk. Jiaul, S/O- Sk. Sakir of Village - Sekhpura, P.O.- Mathurapur, P.S.- Manikchak, District - Malda, Pin - 732203 has filed a petition for recording his name in respect of 4.95 decimal of land at Plot no.6 of Mouza - Anathpur, JL No. 57. He submitted a registered Deed being no. 424 of A.D.S.R. Manikchak dated 29.06.2016 in support of his claim. D.A. please issue notices upon all concerned and ask them to appear before the undersigned on 31.05.2017 at the office premises of B.L&L.R.O. Manikchak at 11 a.m.

The case is put up for hearing today. The applicant is present & filed hazira and the O.P.- Azad Hossain, S/O- Late Abdur Rashid of Village - Sekhpura, P.O.- Mathurapur, P.S.- Manikchak, District - Malda, ie, the recorded owner of that scheduled land ( JL - 57, Mouza - Anathpur, Plot no.- 6, Khatiyan no. 283 ) is also present. However he doesn't file hazira. Heard both the parties at length. After detailed scrutiny of the case record, it appears that O.P.- Azad Hossain, S/O- Late Abdur Rashid, the recorded owner of that scheduled land has transferred 4.95 decimal area of scheduled land ( JL - 57, Mouza - Anathpur, Plot no.- 6, Khatiyan no. 283 ) to Sk. Jiaul, S/O- Sk. Sakir of Village - Sekhpura, P.O.- Mathurapur, P.S.- Manikchak, District - Malda vide registered Deed being no. 424 of A.D.S.R. Manikchak dated 29.06.2016. However on verification of the finally published R.O.R. it appears that the Plot no.6 of Anathpur Mouza is part-vested. On further verification of the records readily available with this office, it appears that a 7AA proceeding was initiated & disposed of against Abdur Rashid, the father of the present O.P.- Azad Hossain on 12.02.1991 declaring 1.17 Acres of land of Plot no. 6 along with several other plots were vested to the State. It also came to the knowledge of the undersigned that several other 7AA cases being no. 24/91, 27/91, 42/91, 43/91 were initiated against Abdur Rashid and his three (3) brothers, S/O. Sk. Ramjan Ali & disposed of, followed by sending them the notice of possession, involving the suit Plot, which are not readily available with this office at this moment, which needs to be verified further. In view of the above stated facts and circumstances and keeping in view the State interest involved and proper adjudication of the instant mutation case, further scrutiny of the 7AA cases is required to ascertain how much area of the scheduled Plot no. 6 was declared vested to the State. After ascertaining the aforesaid fact the case will be taken up for disposal. Till then the instant case is kept adjourned for the end of justice.
